Service Agreement

Hey there! My service agreement is all about what I'll be doing for you and what's included in my fee. I want to make sure you know exactly what to expect. It's important to understand that we both have responsibilities. After all, we want everything to go smoothly! But hey, life happens, right? If any unexpected changes come up, we'll have a backup plan ready so you can feel confident about what comes next.

Terms and Conditions: Bee Together Celebrant Services

This agreement outlines the terms and conditions for services provided by Gabrielle Quigley, authorised Marriage Celebrant

(The Celebrant), to the Couple.

 

1. Celebrant’s Services

Provision of Services

The Celebrant will provide marriage celebrant services in accordance with the Marriage Act 1961 (Cth). This includes preparing, completing and lodging all required legal documentation, including the Notice of Intended Marriage (NOIM), Declaration of No

Legal Impediment, and registering the marriage with the Registry of Births, Deaths and Marriages within the legally required timeframe following the ceremony.

Attendance and Performance

The Celebrant will attend and conduct the marriage ceremony at the agreed time, date, and location. If the Celebrant becomes unable to attend due to illness or unforeseen circumstances, the Couple will be notified as soon as practicable. Reasonable efforts will be made to assist in securing a replacement authorised celebrant and transferring any prepared legal documentation.

Authority to Solemnise Marriage

The Celebrant reserves the right to decline to solemnise the marriage if legal requirements under the Marriage Act 1961 are not met or if the Celebrant reasonably believes the marriage cannot proceed under Australian law.

Ceremony Script

The Celebrant will prepare and provide a draft ceremony script based on information supplied by the Couple via Google shared document. A full draft will be provided approximately one month prior to the ceremony, excluding personal vows and any agreed confidential content. A major rewrite of the script within two weeks of the wedding date will incur an additional fee of $250

Intellectual Property

The ceremony script remains the intellectual property of the Celebrant and may only be used by the Couple for their personal wedding ceremony.

Post-Ceremony Provision

Where applicable, the Celebrant may provide copies of the ceremony script, vows, and selected materials after the ceremony for personal keepsake use.

Referral for Relationship Services

If requested, the Celebrant may provide information on local relationship support services.

2. Fees and Payment

Reservation of Wedding Date

A non-refundable booking fee is required to secure the ceremony date. Upon payment, the Celebrant reserves the date exclusively for the Couple and declines other bookings for that time.

Final Payment

The remaining balance is due no later than 30 days prior to the ceremony date, unless otherwise agreed in writing.

For bookings made within six weeks of the ceremony, full payment is required at the time of booking.

Non-Payment

If the balance is not paid by the due date, the Celebrant reserves the right to:

  • Cancel the booking and retain the booking fee; and/or

  • Decline to perform the ceremony.

The Couple will be notified in writing of any cancellation due to non-payment.

3. Cancellations, Postponements and Refunds

Cancellation

If the Parties choose to cancel the ceremony, written notice must be provided to the Celebrant as soon as possible.

The booking fee is non-refundable, as it secures the ceremony date and allows the celebrant to Lodge the Notice of Intended Marriage and commence initial planning and administrative preparation. The Parties acknowledge that a significant portion of the Celebrant’s work is completed prior to the ceremony date, including bespoke writing, planning and preparation. Couples have booked me to craft a ceremony as well as reserved a time slot. Where cancellation occurs after ceremony preparation has commenced, the following applies:

More than 30 days notice

Where cancellation occurs after ceremony preparation has commenced, a Ceremony Creation Fee of $450 will be payable. This reflects the time, communication, and creative work involved in designing a personalised ceremony.

Less than 30 days notice

If cancellation occurs within 30 days of the ceremony date, the full balance remains payable, as the date has been exclusively reserved and the ceremony will have been substantially or fully prepared. If the ceremony is postponed, the Celebrant will make reasonable efforts to accommodate a new date subject to availability. If unavailable, the booking may be treated as a cancellation.

4. Documentation and Legal Compliance

Required Documentation

The Couple must provide all required legal documentation within the timeframe requested by the Celebrant.

All information must be accurate. Providing false or misleading information in legal documents is an offence under Australian law.

Legal Requirements

Two witnesses aged 18 years or older must be present and sober at the ceremony.

The Celebrant is legally required to include prescribed wording under the Marriage Act 1961, which cannot be altered.

If witnesses are deemed unsuitable, alternative witnesses must be provided.

5. Timing, Venue and Ceremony Conditions

Changes to Ceremony Details

Any changes to time, date or venue must be communicated to the Celebrant as soon as possible. The Celebrant reserves the right to cancel the booking if unable to accommodate changes.

Arrival and Timing

The Celebrant will arrive approximately 45–60 minutes prior to the ceremony start time. For legals Only ceremony arrival time is 20 minutes. The Celebrant will remain for approximately 20 minutes after the ceremony to complete legal documentation.

Venue Conditions

The Celebrant is not responsible for venue restrictions, staffing issues, or external vendor interruptions.

For outdoor ceremonies, the Couple must arrange a wet weather alternative and advise the Celebrant accordingly. The celebrant will not perform the ceremony in the rain nor subject the PA equipment to damaging weather conditions.

6. Delays and Additional Charges

If the ceremony is delayed by more than 20 minutes due to the Couple’s absence or circumstances outside the Celebrant’s control, the Celebrant may leave the venue.Any additional costs incurred due to delays (including parking or extended time) may be charged to the Couple. A rescheduling fee of $250 may apply if the ceremony cannot proceed as planned.

7. Intoxication and Conduct

The Celebrant is legally required to refuse to solemnise the marriage if either party appears under the influence of alcohol or drugs to the extent that consent cannot be clearly established. Any prescribed medication that may affect capacity should be disclosed in advance.

8. Witnesses

Two witnesses aged 18 or over must be present, sober, and able to understand the ceremony. If unsuitable, alternative witnesses must be arranged before the ceremony proceeds.

9. PA System and Equipment

Where a PA system is provided, it will be tested prior to the ceremony. While reasonable care is taken, the Celebrant cannot guarantee performance of equipment and is not responsible for technical failure.

10. Image Use and Privacy

The Couple agrees that the Celebrant may use ceremony images for marketing purposes unless otherwise advised in writing.

All personal information is handled in accordance with the Privacy Act 1988. Your Love Story and Personal Vows are not shared.

 

11. Force Majeure

If the Celebrant is unable to perform the ceremony due to circumstances beyond reasonable control (including illness, accident, weather events, natural disaster, or government restrictions), reasonable efforts will be made to assist the Couple in securing an alternative authorised celebrant.

12. Obligations and Legal Acknowledgement

The Celebrant has explained the legal requirements for entering marriage under Australian law.

The Couple acknowledges their responsibility to provide accurate information and comply with all legal obligations required for the marriage to proceed.  If this is not understood in any way the Parties must make this known to the Celebrant on reading these Terms and Conditions.

 

The Celebrant has a Public Liability insurance policy and will take all precautions within her control to ensure that the site and conditions pose no risk to any person attending the ceremony.
